It may be unlawful to rent out holiday homes in Spain
A new law could prevent homeowners to rent their properties out to vacationers. If the bill is passed by the Senate, it will be illegal for private renting out their homes il tourists on short-term contracts.
In an effort to help those struggling in the hotel sector, the government has decided to update the Urban Rental Law (LAU) to hand over control of lettable area to the regional authorities. Hotel owners claim that the practice of independent rental properties over the internet undermines the tourist trade creating unfair competition.

It is estimated that thousands of properties would be affected if the law takes effect. “While it is true there is much sordidness in the rental industry, we are against this,” explains David Tornos, president of Asotur, an organization that manages the rental of homes to for tourists. “We all pay our taxes and do things by the book, but the hotels think we’re pirates. We just hope they do not accept this law and let us alone. ”

Lawyer Antonio Flores, from the firm Lawbird, insists that a new law can actually lead to more illegal rental of holiday homes. “If the rental is done legally, it should not be a problem. But if the law is too restrictive, it will lead to more hidden rental.
